SALES CONDITION EXTRACT 1

All lo. gas s.r.l. products are sold exclusively Ex-Works Vicenza, unless other wise agreed upon. The goods will always travel on risk and responsibility of the client, even in the case in which the client will ask to lo. gas s.r.l. to coordinate or choose the transport company or agent on its behalf.

2 Claims are not accepted after 8 (eight) days from the date of receiving the goods by the client. The goods cannot be returned, substituted, or repaired without prior written consent by the company lo. gas s.r.l.

3 In case of justified claim, the company lo. gas s.r.l. will see to the repair of the defected parts that is recognized as faulty and within the warranty conditions stated here under. lo. gas s.r.l. is not responsible for any goods which are lost or damage, directly or indirectly, that may be caused by the client or by any third party. In any case of claim only lo. gas s.r.l.’s Warranty Conditions will be observed.

4 All claims that refer to errors or delay in delivery must be made in writing and must be indicated with 20 (Twenty) days in advanced and prior to the delivery of the order in process. lo. gas s.r.l. will do all its best to its ability as to resolve every delay or error caused to the delivery. However, the terms of delivery is given only as indicative and no reimbursement will be given, to the client, for any delay, omission, error of delivery or shipment.

5 Any written or stamping errors can be ratified without prior notice

6 lo. gas s.r.l. reserves the right to modified and/or change the prices and products of its price list without notice.

7 The sales conditions is an integral part of the price list.

8 The acceptance on behalf of the client to lo. gas s.r.l.’s goods, binds the client without any reserves to the herein written clauses and sales / warranty conditions herein specified.

9 In case of controversy, the terms herein shall be shall be subject to and construed according to the Italian law. Any disputes arising under or in connection with the herein listed conditions shall be settled and decided by the Court of Vicenza.

10 The herein, lo. gas s.r.l.’s price list nulls and substitute all previous price lists and/or special sales conditions.

WARRANTY CONDITIONS

lo. gas s.r.l. warranties that all its products are free from defects and manufacturing flaws.

All lo. gas s.r.l. products are warranty for 12 months from the date of in which the product is sold to the client.

The warranty consists, following a control of the claimed samples and written acceptance by lo. gas s.r.l., in providing repair of the product/s that are inefficient or that cannot be used due to manufacturing flaws or that are proven to be defected by lo. gas s.r.l.

The warranty does not cover the products ore its parts that will result defective caused by:
a- Improper installation or maintenance.
b- Negligence or improper use.
c- Mishandling or maintenance perform by unauthorized personal.
d- Damage created by transport, handling or circumstances that are not related or referred to defects on production.
e- All parts or products that have undergone through its normal life cycle mishandled by unauthorized personal.

It is also considered without warranty:
a. Periodical maintenance.
b. Repair and/or substitution of parts due to its use and its natural deterioration.
c. Incidents or accidents caused by force majeure that not dependent from the will of the company lo. gas s.r.l. d. Damage of parts due to poor quality of the gas used, such as gas with high contents of acids, corrosive additives, caustic soda or sulfur.

The company lo. gas s.r.l. declines any responsibility for damage caused to persons, things or animals as a consequence to misuse of the lo. gas. s.r.l. parts, goods, and equipment by unauthorized, or adequately trained installers by lo. gas s.r.l. technicians.
